Goan Real Estate & Construction Private Limited (collectively referred to hereinafter as “GRECPL”, “Company”, “our”, “us” or “we”), a company duly incorporated under the Companies Act, 1913, with registered address as Dynamix House, Yashodham, General A. K. Vaidya Marg, Goregaon (East), Mumbai, Maharashtra, India – 400063, operating the Clube de Palma (“Club”), a distinguished private membership facility, and the website https://dynamixclubedepalma.co.in/ , and the corresponding Club de Palma mobile and tablet applications (collectively referred to as the “Platforms”). The Company through its Platform, inter alia, offers various services (“Services”) to the members of the Club (collectively referred to as, “Member(s)” or “you” or “your”).
While transacting on the Platforms, you can expect a hassle-free experience.
This cancellation and refund policy (“Policy”), together with the other policies uploaded on the Platforms sets out the Company’s procedures and policies in accepting cancellation of the Services and refund of corresponding amount thereof, if any. Any cancellation of Services by you are subject to the terms and conditions set out under this Policy.
1. APPLICABILITY OF POLICY
1.1 By agreeing to use the Platforms and/or initiating a request for purchase of Services (including purchase of the Club membership) on the Platforms, you agree to be bound by the terms contained in this Policy without modification. If you do not agree to the terms contained in this Policy, you are advised not to transact on the Platforms and forthwith leave and stop using the Platforms.
1.2 Please note that we may, from time to time, change the terms of the Policy that governs your refund or cancellation of a Service. Every time you wish to use the Platforms, please check the Policy to ensure that you understand the terms and conditions that apply at that time.
2. TERMS FOR CANCELLATION AND REFUND
2.1 No Cancellation and Refund Policy: Payments made online for Services are non-cancellable and non-refundable, unless otherwise determined by the Company or required by the applicable laws. Under certain laws, you may be entitled to a refund or other remedies for a failure in the provision of the Services. In such exceptional circumstances, the Company reserves the exclusive right to allow a refund on a case-by-case basis. The determination of such is subject solely to the discretion of the Company
2.2 Discontinuation of Club Membership: Members retain the option to discontinue using their membership with the Club or not to renew their membership upon its expiration. This decision does not, however, entitle the Member to any form of refund for the unutilized portion of their ongoing membership term.
2.3 Mode of Refund: In the event that the Company, initiates any refund, the following terms shall be applicable
(a) Refunds will require a minimum of 7 business days for processing. The Company shall not be held liable for any delays caused by third-party financial institutions, payment gateways, or unforeseen circumstances. You acknowledge that after initiation of refund, it may take additional time for your refund to reflect in your account which is subject to your financial institution or payment solution provider terms and conditions.
(b) We may use a third-party payment processor (“Payment Processor”) to bill you through your selected mode of payment. The processing of payments will be subject to the terms and policies of such Payment Processor and the designated banks in addition to this Policy.
(c) Any refunds for payments made online will be processed through your registered bank account.
2.4 Bank and Processing Charges: Any bank or processing charges incurred during the refund process will be deducted from the refundable amount and will be borne by you
2.5 We shall not be liable for any error in any unsuccessful payment or refund whether direct or indirect, that may occur due to the following reasons.
(a) error of the Payment Processor or the banks
(b) due to terms and conditions of the Payment Processor or the banks.
(c) lack of authorization for any transaction.
(d) exceeding the pre-set limit mutually agreed upon between You and your respective bank.
(e) any form of financial loss resulting directly or indirectly from the aforementioned scenarios.
(f) decline of the transaction for any other reason.
